The legal framework, in brief

Indonesian immigration is governed by the Immigration Law (UU 6/2011, as amended, most recently by UU 63/2024), its implementing regulation (PP 31/2013, as amended by PP 40/2023) and the ministerial regulation on visas and stay permits (Permenkumham 22/2023, as amended by Permenkumham 11/2024). Immigration now sits with the Ministry of Immigration and Corrections (Kementerian Imigrasi dan Pemasyarakatan) (Perpres 157/2024). Permen Imipas 3/2025 Pasal 45 partially revokes and declares ineffective Permenkumham 22/2023 Pasal 43, Pasal 45, and Pasal 52–55 (as amended by Permenkumham 11/2024).

Employing a foreign worker is a separate question governed by manpower law: PP 34/2021 on the Use of Foreign Workers and Permenaker 8/2021. A stay permit (KITAS) lets you stay in Indonesia. It does not by itself settle whether a particular job or paid activity is allowed.

You may still see the term "IMTA" in older material. Under the current regime the employer's approved RPTKA is the basis for employing a foreign worker (PP 34/2021).

KITAS types we handle

"KITAS" is the common name for the limited stay permit (ITAS). The category of visa and ITAS decides what the holder may do in Indonesia.

Work KITAS

For
a foreign national employed by an Indonesian company.
Sponsor
the employing Indonesian entity.
Basis
the employer's approved RPTKA for the specific position (PP 34/2021; Permenaker 8/2021), then the visa and ITAS (Permenkumham 22/2023, as amended).
Limits
the permit is tied to the employer and the approved position. A change of employer or role must be checked before it happens.
We handle
the position check, RPTKA, visa and ITAS, renewals and post-arrival compliance.

Investor KITAS

For
foreign shareholders and investors in an Indonesian company.
What it allows
the permitted activities and any work or director role depend on the visa/ITAS basis and on the applicable employment approvals. We confirm the current category before any work begins (Permenkumham 22/2023, as amended by Permenkumham 11/2024; PP 34/2021).
We handle
the category check, coordination with your PT PMA set-up, the application and renewals.

Spouse / family KITAS

For
foreign spouses of Indonesian citizens and other family members eligible for family reunification under the applicable visa and stay-permit rules.
Sponsor
the applicable Penjamin or Penanggung Jawab under the current visa and stay-permit rules. For family reunification, the relevant category and documents depend on the relationship and sponsor; see Permenkumham 22/2023, Pasal 33 ayat (2) huruf h and Pasal 44, 46–50, as applicable, and Permen Imipas 3/2025, Pasal 3 ayat (2) huruf b and Pasal 14–17 for the diaspora/Indonesian-spouse route.
Work
a spouse/family ITAS does not by itself answer whether a particular paid activity is permitted. The activity, and any employment approval it needs, must be checked for the person and the role (PP 34/2021).
We handle
the eligibility and sponsor check, the application and renewals.

Work permit process: RPTKA to KITAS

Each step depends on the one before it. The employer and the foreign worker each have obligations (PP 34/2021; Permenaker 8/2021; Permenkumham 22/2023, as amended).

  1. 1

Position check (employer). We confirm the position may be filled by a foreign worker, and whether the employer must appoint an Indonesian counterpart worker and provide training (PP 34/2021).

  2. 2

RPTKA (employer). The employer applies to the Ministry of Manpower for approval of its foreign-worker utilisation plan (RPTKA) for the position (PP 34/2021).

  3. 3

DKPTKA (employer). The employer pays the foreign-worker compensation fund (DKPTKA) as required (PP 34/2021).

  4. 4

Visa (sponsor and worker). The visa application is filed with the employer as sponsor (Permenkumham 22/2023, as amended).

  5. 5

Arrival and ITAS (worker). After arrival the stay permit (ITAS) is issued under the visa category (PP 31/2013, as amended; Permenkumham 22/2023, as amended).

  6. 6

Ongoing compliance (employer and worker). Reporting, renewals and changes of position or employer follow the manpower and immigration rules (PP 34/2021; Permenkumham 22/2023, as amended).

Golden visa

Indonesia's golden visa is a long-stay visa and stay permit for qualifying foreign nationals, including investors (PP 40/2023; Permenkumham 22/2023, as amended by Permenkumham 11/2024).

We handle: the check on whether you may qualify under the current rules, coordination of any investment structure with our foreign-investment team, and the application.

The qualifying categories, investment requirements and stay periods are set by regulation and change from time to time. We confirm the current requirements at intake.

KITAP (permanent stay permit)

KITAP is the permanent stay permit (ITAP). It is different from KITAS, the limited stay permit. KITAP is a stay permit. It is not citizenship, and it can be cancelled (PP 31/2013, as amended; Permenkumham 22/2023, as amended).

Whether, and when, a KITAS holder can move to KITAP depends on their stay-permit category and history. We check eligibility against the current rules for your category before we apply.

We handle: the eligibility check, the application and extensions.

Documents

Documents commonly requested vary by category and case. We confirm the current checklist for your case at intake (Permenkumham 22/2023, as amended by Permenkumham 11/2024).

Frequently asked questions

Do I need a lawyer to get a KITAS in Indonesia?

The law does not require you to use a lawyer. The application needs the correct visa category, sponsor and documents, and for work, the employer's RPTKA approval (Permenkumham 22/2023, as amended; PP 34/2021). A lawyer helps you choose the correct basis and keeps both the employer and you compliant.

Can I work in Indonesia on an investor KITAS?

It depends. The activities you may carry out, including a director role, depend on the visa/ITAS basis and on the applicable employment approvals (Permenkumham 22/2023, as amended by Permenkumham 11/2024; PP 34/2021). We confirm the current category before you start any work.

Can a foreign spouse on a spouse KITAS work?

It depends. A spouse/family ITAS does not by itself answer whether a particular paid activity is permitted. The activity, and any employment approval it needs, must be checked for the person and the role (Permen Imipas 3/2025, Pasal 3 ayat (2) huruf b and Pasal 14–17; Permenkumham 22/2023, as amended, only where applicable; PP 34/2021).

How long is a KITAS valid and how is it renewed?

Validity depends on the visa and ITAS category. The extension must be applied for before the permit expires (PP 31/2013, as amended; Permenkumham 22/2023, as amended). We track renewal dates for our clients.

What is the difference between KITAS, KITAP and the golden visa?

KITAS is a limited stay permit. KITAP is a permanent stay permit, but it is not citizenship and it can be cancelled. The golden visa is a long-stay visa and stay permit for qualifying foreign nationals, including investors (PP 31/2013, as amended by PP 40/2023; Permenkumham 22/2023, as amended by Permenkumham 11/2024).

What happens to my KITAS if I change employer?

A work KITAS is linked to the employer and the approved position in its RPTKA. A change of employer or role must be checked before it happens (PP 34/2021; Permenkumham 22/2023, as amended). Talk to us before you accept a new role.
